Members of the Supreme Court expressed concern Wednesday about pollution that reaches navigable waters by traveling through groundwater, but the justices also worried that residential septic tanks could get swept into the regulatory solutions.
The U.S. Supreme Court will hear arguments in a Clean Water Act case with major implications for agriculture, while farm groups who back a bipartisan ag labor bill will be lobbying lawmakers ahead of an expected House committee debate.
The rule replacing the 2015 definition of “waters of the U.S.” is expected in the next few months, but that doesn’t mean federal courts won’t have Clean Water Act cases to deal with in the meantime — and for years to come.
A decision by Maui County, Hawaii, appears to have ended hopes of farm groups for a favorable Supreme Court decision on the scope of the Clean Water Act.
