The National Association of Attorneys General sent a formal letter to congressional leaders seeking clarification on the federal definition of hemp in response to a perceived loophole in the 2018 farm bill. 

Backed by a bipartisan group of 39 state and territory attorneys general, the letter urges lawmakers to prevent the sale of “intoxicating hemp-derived THC products” due to “a grievously mistaken interpretation of the 2018 Farm Bill’s definition of ‘hemp.’”

NAAG is targeting the sale of synthetic cannabinoids, including delta-8, delta-10, and THC-O, claiming that these products are being manufactured and sold without consistent age restrictions, labeling standards or safety requirements. 

The coalition wants the definition to be clarified during the FY 2026 appropriations process or farm bill reauthorization to swiftly “shut down this industry before it metastasizes further into an even greater threat to public safety than it already is.”
