After a dramatic withdrawal of support from a key ethanol bill in October, the American Petroleum Institute is once again teaming up with ethanol stakeholders to push the Trump administration and Congress to help get the legislation over the finish line. And in a new development, the groups also are united in asking for a revamping of policy that allows small refiners to seek exemption from biofuel-blending rules. 

The Environmental Protection Agency on Tuesday issued a long-awaited proposal on the thorny issue of exempting some small oil refiners from US biofuel-blending mandates, The agency is proposing two options for reallocating exempted biofuel volumes – either full reallocation, or 50% reallocation.

The Supreme Court has agreed to decide whether challenges to EPA small refinery exemption decisions can be heard in federal appeals courts other than the D.C. Circuit Court of Appeals.

Biofuel leaders expressed disappointment Friday in a ruling from a federal appeals court overturning what they said are “most” EPA decisions in 2022 to deny requests for small refinery exemptions from the Renewable Fuel Standard.
