SIOUX CITY, IA, Sept. 27 - Grain exporter Bunge can continue to refuse delivery of corn containing one of Syngenta’s biotech traits – for now. A federal judge denied a request by Syngenta for a temporary injunction. Corn containing the company’s Agrisure Viptera trait has been approved for import into several key markets, but not China.
In rejecting Syngenta's request, U.S. District Judge Mark W. Bennett in Sioux City, IA. said the public interest would best be served '...in fostering export markets for United States corn, in allowing business to make legitimate business decisions, and in allocating the risk of commercialization of a new transgenic corn trait upon the party that commercialized the trait...'
Bunge said in a statement the ruling validates its decision to reject Viptera corn at all of its locations. Syngenta said the lawsuit is only part of its determination to “secure greater clarity” for farmers regarding industry marketing practices for new seed technologies, and its determination on that issue is unchanged.
